Recording, Privacy and Responsible Use Notice

KinaBot is a personal wellness reflection service provided by AImoji LLC. This notice explains your responsibilities when recording or uploading audio and how KinaBot handles information generated through the service.

1. Record Your Own Voice

KinaBot is designed for users to record and analyze their own speech.

You must not secretly record, upload, or submit another person’s voice. If another person may be heard in a recording, you must first obtain their clear and informed permission and comply with all applicable recording, privacy, and data-protection laws.

Do not upload audio that you do not have the legal right to use.

Some jurisdictions require the consent of every participant before a confidential conversation may be recorded. For example, California law generally prohibits intentionally recording a confidential communication without the consent of all parties. California Penal Code §632

2. Your Responsibilities

By recording or uploading audio, you confirm that:

  • The recording is primarily of your own voice; or
  • You have obtained all permissions required from every identifiable person in the recording;
  • You have the legal right to submit the recording to KinaBot;
  • The recording does not violate another person’s privacy, intellectual-property rights, or applicable law; and
  • You will not use KinaBot to analyze another person without that person’s knowledge and permission.

AImoji LLC may suspend or terminate access when it reasonably believes the service has been used unlawfully, deceptively, or in violation of these rules.

3. How Audio Is Handled

Audio submitted to KinaBot is processed temporarily to generate speech and language features.

KinaBot does not retain the raw audio recording or full transcript after processing is completed. Raw audio and full transcripts are not sent to OpenAI.

KinaBot retains the information needed to operate the service, including your account information, session history, derived feature scores, trend data, and optional habit check-ins, as described in the KinaBot Privacy Policy.

Anonymous score history—not raw audio or full transcripts—may be used to generate general wellness information after sufficient sessions have been completed.

KinaBot will not use a raw recording for product training or research unless the user is separately informed and provides affirmative consent.

4. Non-Medical Purpose

KinaBot is a non-medical wellness and personal reflection product.

It does not diagnose, screen for, predict, prevent, monitor, or treat dementia, cognitive impairment, mental health conditions, or any other disease or medical condition.

KinaBot’s scores, trends, and explanations describe observable characteristics of submitted speech samples only. They do not indicate a person’s health, cognitive ability, improvement, decline, or medical risk.

KinaBot does not provide medical or legal advice. If you have health concerns, consult a qualified healthcare professional. If you need legal advice concerning a recording or privacy law, consult a qualified attorney.

5. Privacy Rights

Depending on your location and whether the relevant law applies to AImoji LLC, you may have rights relating to access, deletion, correction, restriction, objection, or portability of your personal information.

Instructions for submitting a privacy request are provided in the KinaBot Privacy Policy.

For California residents, applicable privacy rights may include the rights to know, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal treatment when exercising those rights. California Attorney General’s CCPA guidance

For individuals in the European Economic Area, United Kingdom, Japan, and other jurisdictions, AImoji LLC will handle applicable privacy requests in accordance with the laws that apply to the service and the individual.

6. Prohibited Uses

You may not use KinaBot:

  • To record another person secretly;
  • To identify or authenticate a person from their voice;
  • For surveillance or monitoring;
  • To make medical, employment, insurance, legal, educational, or eligibility decisions;
  • To analyze a child without authorization from a parent or legal guardian;
  • While driving, operating machinery, or performing another activity requiring full attention; or
  • For any unlawful, harmful, deceptive, or discriminatory purpose.

7. Acceptance

By selecting “I understand and agree,” recording audio, uploading a file, or otherwise using KinaBot, you acknowledge this notice and agree to use the service responsibly and lawfully.
